A SUSPENDED prison sentence was imposed on a Jacobstow man who drove after consuming alcohol.
Mark Antony John David Sellers, aged 45 of Jacobstow, Bude appeared at Liskeard Magistrates' Court on April 3.
The court heard that on March 8 at Bude, Mr Sellers drove after consuming alcohol, namely 100 microgrammes in 100 millilitres of breath, exceeding the limit.
A guilty plea was indicated and the defendant was sentenced to 12 weeks imprisonment, suspended for 12 months. Magistrates said the suspended custodial sentence was imposed because of the high reading and because a similar offence was committed whilst on bail.
A 42 day curfew was imposed requiring the defendant to remain indoors at his home on Tuesdays, Thursdays, Fridays, Saturdays and Sundays from 7pm to 7am. The defendant is to be electronically monitored.
He was also disqualified from driving for three years, to be reduced by 36 weeks if he completes an approved course by December 3, 2011.
Having committed a further offence whilst subject of a suspended sentence, imposed on January 15 at East Cornwall Magistrates' Court for being in possession of a bladed instrument, the suspended sentence was varied by adding a curfew requirement for 21 days to run consecutively to the suspended sentence order made last week.
Magistrates said the suspended sentence order was not activated because it was a dissimilar offence and the defendant is a "vulnerable person who is having help to address his problems."
