Planning permission is required for the construction of an earth banked lagoon in St Endellion.

Mr Peter Harris had applied to Cornwall Council for a prior notification to determine if permission was required for the plans.

In its response, Cornwall Council said that it would not be considered ‘agricultural permitted development’ and planning permission was needed.

The authority’s response said: “The proposed construction of an earth banked lagoon on land at Tolraggott Farm, Port Isaac is not considered to constitute agricultural permitted development as defined in Class A, Part 6, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) because the development is larger than 1000sqm in ground area, therefore an application for planning permission will be required. Part 6, Class A - agricultural development on units of 5 hectares or more, permits A.

“The carrying out on agricultural land comprised in an agricultural unit of 5 hectares or more in area of (a) works for the erection, extension or alteration of a building; or (b) any excavation or engineering operations, which are reasonably necessary for the purposes of agriculture within that unit. Development is not permitted if; (e) The ground area of the development would exceed 1000sqm.”
