AN APPEAL has been made following Cornwall Council's decision to refuse a planning application at Fusion Fitness Ltd in Bude.

The application sought permission for the lifting of condition 9 of a previous application (opening hours) to operate from 8am to 8pm, Monday to Friday, Saturday 8am to 4pm and Sunday 9am to 4pm at the gym, located at Burn View, Flexbury, Bude.

The council refused permission as officers felt the applicant failed to demonstrate that the proposal would not result in a noise nuisance to neighbouring residential properties.

Additionally, the proposed earlier opening hours would compound 'an existing noise nuisance problem,' resulting from the premises.

The council said: "It would therefore result in an unacceptable impact upon the residential amenity of neighbouring properties, contrary to the North Cornwall District Local Plan 1999 and PPG 24 Planning and Noise (September 1994).

The appeal — lodged by Fusion Fitness Ltd —is to be decided on the basis of an exchange of written statements by the parties and a site visit by an inspector, the council advised.
